  • Litigation and Dispute Resolution

Litigation has been BaskinGrant’s core practice since 1979. We routinely represent clients in complex, high stakes cases. Our attorneys are widely recognized as tenacious advocates for our clients. We provide strategic advice and understand our clients’ business needs and concerns in all litigation and alternative dispute resolution forums. Our seasoned litigators possess extensive trial and appellate skills, in-depth knowledge of state and federal courts, technological know-how, and practical business judgment, all of which contribute to our consistent delivery of exceptional, cost-efficient services. We also recognize that litigation may not always be the best course for our clients. To this end, we offer a broad range of pre-litigation counseling and alternative dispute resolution services, so that our clients can avoid litigation when possible. We work with each of our clients to achieve the best outcome under the circumstances, in a prompt and cost-effective manner.

Our litigation practice extends to many areas of the law, including Business, Corporate, and Taxation Law, Real Estate and Land Use, Construction, Employment Law, Bankruptcy, Intellectual Property, Trust, Estate, and Probate Law, and Family Law.  Our substantive knowledge of the law in each of these areas is instrumental in maximizing client benefit.  We utilize advanced litigation support technology and we hire well-trained practitioners to process it, allowing our services to be efficient and affordable. We also have litigation expertise in the following areas:

    • Alternative Dispute Resolution: BaskinGrant attorneys are experienced in the various methods of alternative dispute resolution, including binding and non-binding arbitration, and mediation, in all recognized dispute resolution forums.  We routinely assist clients utilizing the American Arbitration Association, JAMS Endispute, and a host of independent retired judges and other independent ADR providers.
    • Appellate: The need for appellate expertise begins in the trial court, and BaskinGrant attorneys are trained to create and preserve the trial record with a view towards maximizing success on appeal.  Whether our clients select BaskinGrant at the trial stage or solely as appellate counsel, we have the experience necessary to preserve a hard fought victory, reverse an unfair judgment, or obtain a favourable post-trial settlement.
    • Class Action Defense: Class actions and representative actions are becoming increasingly prevalent in the current legal climate.  These actions are often complex and involve high stakes outcomes, presenting risk of substantial damage awards and other exposure to commercial enterprises.  BaskinGrant attorneys are uniquely knowledgeable and experienced in the specialized issues involved in these actions.  We have litigated class and representative actions in a variety of substantive areas of law, including wage and hour and other employment law issues, California’s Unfair Competition Law (“17200”), securities fraud and shareholder actions, and franchise fraud.
    • E-discovery: Electronic data is a business reality, and electronic discovery (e-discovery) issues are many times pivotal in litigation today.  BaskinGrant utilizes the most current technologies, and is well-equipped to advise clients concerning every-day data retention policies, preservation of discoverable electronically stored information during litigation, and responding to discovery
    • Federal Bankruptcy Non-Dischargeability Litigation: The Firm enjoys a solid reputation assisting clients involved in litigation in bankruptcy court, including actions seeking relief from the automatic stay and preference recovery, and fraudulent transfer actions.  We also defend these actions when they are brought against creditors.
    • Securities Litigation: Securities litigation is a multifaceted area of practice.  The securities laws are complex, and securities cases typically involve sensitive, high stakes matters.  Securities claims present the risk of substantial damage awards and adverse publicity, as well as other serious risks and exposure.  Often the threatened exposure bears little relation to the true merits of the claims.  BaskinGrant has a history of successfully defending privately-held clients against securities claims, both in direct and representative actions.
